Toxic Tort

Toxic tort is a special type of personal injury lawsuit in which the plaintiff claims that exposure to a chemical caused injury or disease. In the United States, toxic materials are found in the air, water, food, work place and even at home. Harmful substances include lead paint, pharmaceutical drugs, toxic mold, pesticides, chemicals and asbestos.
Most toxic tort cases have arisen either from exposure to pharmaceutical drugs or occupational exposures. There have also been many occupational toxic tort cases, because industrial and other workers are often chronically exposed to toxic chemicals, more so than consumers and residents.
Because of the abundance of toxic materials in our country, there is a serious risk of exposure that can lead to injury, disease and death. Victims of a personal injury caused by exposure to a toxic substance may seek recourse for serious injuries.
Toxic tort cases often result in a class action lawsuit, because toxic exposure usually affects more than one person. Most pharmaceutical toxic injury cases are mass tort cases because drugs are consumed by thousands of people, many of whom have become ill from a toxic drug.
